Introduction:
The Palestinian Liberation Organization has received a grant from the International Development Association (IDA) in the amount of USD 20 million for the benefit of the Palestinian Authority (PA) to finance the Digital West Bank & Gaza Project (the Project). The Project will seek to produce concrete and tangible results for the Palestinians through increased access to high-speed broadband services and increased access to selected e-services to citizens and businesses. The Project will focus on key points to unleash digital transformation in the Palestinian territories addressing some of the bilateral challenges allowing digital transformation to achieve its full potential. It will strengthen the digital resilience of the Palestinian territories and the ability of the PA to respond to shocks, such as COVID-19.
The Project takes a multi-disciplinary approach to support the digital transformation, COVID recovery and resilience of the West Bank and Gaza. The Project will be implemented and overseen by the Ministry of Telecommunications and Information Technology (MTIT). Individual activities are to be implemented by MTIT and the High Council for Public Procurement Policies (HCPPP), over a 5-year period

Background:
This ToR aims to obtain consulting services for the purposes of achieving the intended purpose of the proposed Digital Palestine project which is to extend and improve access to critical ICT infrastructure for the public and private sectors; improve ICT governance; improve access to government services; and reduce infrastructure costs by providing reliable, fast and adaptive digital systems for a government that will facilitate the provision of e-services, thereby enhancing public service delivery.
The Government, therefore, intends to use part of the project funding for the procurement of consultancy services, on the implementation of the newly enacted (December 2021) Telecommunications Law.
A recent decree was issued in the Telecommunications Law, which aims of addressing legal and regulatory challenges arising from the dynamic technology changes in the telecommunications sector. The new Telecommunications Law establishes the Palestine Telecommunications Regulatory Authority (TRA), as well as provides revised mandates on licensing, monitoring, and enforcement in the Telecommunications sector. 

Objective:
The objective of the consulting services is to develop a comprehensive plan with a supporting roadmap and a result-based action plan for the implementation of the Law. The consultant shall also provide advisory and technical support services necessary for the implementation of the Law. Review the legal and regulatory environment and identify the appropriate regulations and other secondary regulations and legislation to give effect to the Law establishing the Telecommunications Regulatory Authority (TRA), considering recent and current developments in the ICT space of government and the country.
Accordingly, the Ministry of Telecommunications and Information Technology (MTIT) intends to hire an individual legal advisor for a temporary period to provide consultancy services as indicated in this

Job Requirements

Qualification and experience
The Consultant is expected to be an Individual Consultant with experience in drafting legislative and regulation which should meet the following minimum requirements:
- Postgraduate University Degree.
- A professional qualification in law.
- Minimum 15 years of experience in legal affairs and legislation.
- Minimum 5 years of experience in legal drafting of legislation
- Detailed knowledge of the Legal and Regulatory Issues affecting the ICT Industry in Palestine.
