Background
    

The UNDP/UN Women/UNICEF Sawasya II Joint Programme (Strengthening the Rule of Law in the oPt: Justice and Security for the Palestinian People) is the United Nations’ foremost programme aimed comprehensively at promoting and advancing the rule of law, justice, security and human rights in Palestine.

During the period 2014-2017 the programme has endeavoured to enhance the capacities of, and public confidence in, rule of law institutions, and strengthen access to justice, security and protection services, especially for women and girls. Interventions are designed with a view to sustainability and linking activities to ‘system-level’ policy development.   

As part of the second phase of the programme and backed by a consortium of development partners, with numerous national and international actors, Sawasya II supports government institutions and civil society working in justice, security and protection to strengthen access to efficient, equitable and accountable services for Palestinians in Gaza and the West Bank, including East Jerusalem. Partnership with UN Women and UNICEF in this joint programme underpins the gender and child rights components throughout the justice chain and within relevant public services.

Civil society partners and academic institutions are vital elements of building an inclusive State of Palestine that respects, protects and fulfils human rights and gender equality, and promotes development, peace and security – the fundamentals of the United Nations’ mission in Palestine. Support rests on a supply and demand equation that combines enhanced service delivery by resilient justice and security institutions with the public’s ability to access such services and hold duty-bearers to account. By increasing public confidence in the sector, support is designed to be catalytic, strengthening state-society relations and creating an enabling environment for development and peacebuilding. Interventions are informed by a coherent theory of change and characterised by flexibility and responsiveness to institutional changes as a result of political developments. The Sawasya II programme is oriented around the following four mutually reinforcing outcomes:

State building efforts are reinforced by legal, regulatory and policy frameworks in line with international standards. Service provision is effective, accountable and inclusive. All Palestinians have access to justice, security and protection without discrimination Women’s access to justice and security improved through gender-responsive service delivery and empowerment of service users

The Sawasya II Joint Programme builds on the achievements and findings of its predecessor programmes, and the comparative advantages of the involved UN agencies. Importantly, the Joint Programme (Sawasya) uses baselines captured during these earlier programmes as a mean to monitor results and inform future planning.

One of its main partners, The Ministry of Justice, leads policy development and reform of the justice sector to ensure the provision of public justice services capable of protecting human rights and providing ready access to justice for all community members, especially vulnerable groups and the poor. The Basic Law, as the de facto constitution, provides strong human rights protections for citizens in the justice sector. Accordingly, the role of the Ministry of Justice in providing access to justice and promoting and protecting human rights is crucial alongside the roles of the courts, the prosecution, police and the Independent Commission for Human Rights (ICHR). Another key area of the MOJ's mandate is in relation to access to justice. The Ministry of Justice has already previously provided leadership on the development of a plan for a national legal aid scheme. One of the key recommendations arising from the inaugural Legal Aid conference was the establishment of a National Legal Aid Committee. The Ministry has prioritized the development of legal aid services units strategic plan, development of a national legal aid policy and strategy, review the draft legal aid law and strengthening of a supportive regulation/bylaw.

UNDP/PAPP is seeking a Human Rights Coordinator. The Human Rights Coordinator will work under the overall guidance of the Chief Technical Specialist and the direct supervision of the Programme Specialist.

As this position is related to Sawasya II Joint Programme (Strengthening the Rule of Law in the oPt: Justice and Security for the Palestinian People) in the occupied Palestinian territory with an expected duration of Three Years, the Service Contract extension will be conditioned to satisfactory performance evaluation as well as availability of funding under the project.

 
    
Duties and Responsibilities
    

Under the direct supervision of the Programme Specialist and the overall guidance of the Chief Technical Specialist will be expected to deliver the following key results:

     Support key institutions of the rule of law, justice and security sector to advance human rights at the levels of policy and practice, including through further organisational development of the human rights units of various institutional partners (e.g. the HJC and the AGO), take into consideration relevant regional and other comparative models adopted in justice sectors' elsewhere to ensure the model accords with best international practices;
    Support Palestinian rule of law, justice and security institutions to mainstream human rights in service delivery to the Palestinian population in accordance with their respective institutional mandates;
    Work with all members of the Legal Harmonisation Working group and ICHR and civil society human rights organisations in Gaza and the West Bank;
    Support internal and external capacity development in the area of human rights, including through trainings with national stakeholders, and advancing a human rights based approach (HRBA) within the work of the Sawasya programme.  
    Support work with the Independent Commission for Human Rights;
    Support Palestinian civil society organisation to further advance human rights, including through the implementation of joint strategies and projects;
    Support partner institutions of the justice and security sector to further strengthen linkages with one another, as well as collaboration with the ICHR and civil society human rights organizations;
    Support partner institutions to develop integrated multi and single year work plans relate to human rights, inclusive of SMART indicators;
    Ongoing provision of technical assistance and advice to members of the Human Rights Units of partner institutions, through implementation of coordinated work plans with counterpart/s to incrementally transfer knowledge and skills to them and closely track implementation of the capacity development plan.
    -Support the leadership of Human Rights Units of partner institutions to provide ongoing advice and regular updates to senior leadership as to progress of the Units.
    Support HRUs to build and maintain strong external and internal networks that could facilitate progress and coordination of human rights and legal aid related activities between other justice institutions, the ICHR and with civil society organizations.
    Fully participate in the UNDP/UN Women Rule of Law Programme including in Programme justice sector coordination meetings, plenary team meetings, review and input of programme documents, regular reporting and other work or activities stemming from the programme, as requested.

Required Skills and Experience
    

    Master’s Degree in Law, International Relations, Business, Political Science, Management or related subject from an accredited university.
    Minimum 4 years of relevant and congruent experience in legal advisory/representative role on gender and Child justice issues with PA institutions, local or international civil society organizations
    Very good knowledge of the justice sector, and practical experience working in the courts in gender and child justice related cases
    Full knowledge of the PA ministerial work environment
    Experience of institutional capacity building
    Experience of legislative policy making and drafting in gender and child justice related issues
    Fluency in Arabic and English with excellent oral and written communication skills in both languages.
